1. Agreement to Terms
By purchasing, accessing, or using any HOMESERVER product or service, you agree to be bound by these Terms and Conditions. If you disagree with any part of these terms, you may not purchase or use our products.
Read carefully. This is not a consumer electronics agreement. This is a professional infrastructure purchase with specific technical requirements and limitations.
2. Definitions
- “HOMESERVER” refers to the physical hardware device, pre-installed software, and accompanying documentation sold by HOMESERVER LLC
- “Customer” or “You” refers to the individual or entity purchasing the HOMESERVER
- “We” or “Company” refers to HOMESERVER LLC
- “Services” refers to the software applications included with HOMESERVER (Jellyfin, Vaultwarden, etc.)
- “Radical Ownership” refers to complete transfer of ownership and control of the hardware and software to the customer upon purchase
3. Product Description and Radical Ownership
3.1 What You Purchase
When you purchase a HOMESERVER, you receive:
- Physical hardware (Intel N100 mini-PC, external USB NAS drive, cables, manual)
- Pre-installed and pre-configured Debian 12 Linux operating system
- Pre-installed open-source and third-party software services
- Pre-installed open-source code provided by HOMESERVER LLC
- Documentation and setup instructions
3.2 Radical Ownership Model
You own this completely. Upon receipt and payment:
- The hardware becomes your property with no restrictions
- You receive full root access to the operating system
- You may modify, customize, or completely reinstall the software
- You may use, modify, and distribute the open-source components per their respective licenses
- HOMESERVER LLC retains no access, control, or telemetry capabilities on your device
3.3 What This Means
- We cannot remotely access your device – by design, for your privacy
- We cannot troubleshoot remotely – you have complete control, we have none
- We cannot update your device – you manage updates via the provided GUI
- We cannot track usage – no telemetry, no analytics, no phone-home functionality
4. Technical Requirements and Competence
4.1 Buyer Beware
HOMESERVER is professional-grade infrastructure, not a consumer appliance. You acknowledge that:
- Setup requires following an 18-step installation process
- Ongoing maintenance requires system administrator-level competence or willingness to learn
- AI assistance (ChatGPT, Claude, etc.) can bridge technical knowledge gaps but does not replace competence
- You may need to use SSH, edit configuration files, read logs, and troubleshoot networking issues
- Third-party services (Jellyfin, Transmission, etc.) require separate learning and configuration
4.2 Network Requirements
You must provide:
- For local access: a router capable of being set to bridge mode OR
- a network switch; potentially in tandem with:
- an access point
- any device capable of accessing the web interface via a modern web browser (e.g., Windows or Linux computers, tablets, etc.)
- For remote access:
- A home network with available internet connection provided by ethernet cable
- Access remotely through the provided VPN or some other means
- Basic understanding of IP addresses, DNS, and network topology
- Ability to configure your existing network infrastructure
4.3 Not Included
HOMESERVER does not include:
- Internet service or connectivity
- Ongoing support subscriptions
- Guaranteed compatibility with all routers or network configurations
- Third-party software licenses (all included software is open source)
- Data recovery services
5. Licensing and Intellectual Property
5.1 Software Licensing
HOMESERVER includes multiple software components with different licenses:
HOMESERVER LLC Website Code:
- Licensed under Business Source License 1.1
- Converts to GNU GPL v3.0 three years after each version release
- You may use, modify, and distribute per the BSL 1.1 terms
- Commercial use restrictions apply during the BSL period
HOMESERVER LLC System Components:
- Licensed under GNU GPL v3.0
- You may use, modify, and distribute freely per GPL terms
Third-Party Open Source Software:
- Each component maintains its original open-source license
- Licenses include GPL, MIT, Apache, and others
- Full license details available in the documentation and GitHub repositories
Debian Linux:
- Licensed under various open-source licenses per Debian’s guidelines
5.2 Proprietary Components
The following remain proprietary to HOMESERVER LLC:
- Manufacturing processes
- Hardware provisioning procedures
- Quality assurance methodologies
These proprietary processes enable us to deliver a working product, but do not restrict your ownership of the device itself.
5.3 GitHub Repositories
All nonproprietary HOMESERVER LLC code is hosted on GitHub and may be inspected, forked, and modified according to the respective licenses. Repository locations are provided in the documentation.
6. Support and Maintenance
6.1 What We Provide
HOMESERVER LLC provides:
- Comprehensive written documentation
- Open-source code repositories with README files
- GitHub Issues for reporting bugs in HOMESERVER LLC components
- Community discussion forums (if available)
- Publicly available knowledge base
6.2 What We Do NOT Provide
HOMESERVER LLC does NOT provide:
- 24/7 customer support hotlines
- Remote device access or troubleshooting
- On-site technical assistance
- Support for third-party software (Jellyfin, Transmission, etc.)
- Guaranteed response times for support inquiries
- Setup or configuration services
- Network configuration assistance beyond documentation
6.3 Third-Party Software Support
For issues with third-party software (Jellyfin, Vaultwarden, Transmission, etc.):
- Support is between you and the respective software projects
- HOMESERVER LLC is not responsible for bugs, security issues, or functionality of third-party software
- We document how we configure these services, but ongoing support is your responsibility
6.4 Community Support Model
Our support model is community-driven:
- Experienced users help newer users
- Solutions are documented publicly for others to benefit
- Technical expertise is shared freely
- No guaranteed response times or outcomes
7. Warranty and Returns
7.1 Limited Hardware Warranty
HOMESERVER LLC warrants that the hardware will be free from defects in materials and workmanship for 30 days from the date of delivery.
This warranty covers:
- Hardware components that fail due to manufacturing defects
- DOA (Dead on Arrival) devices that will not power on
- Any hardware malfunction during the warranty period
Warranty Remedy:
- Free replacement device (swap) for any hardware defect within 30 days
- Customer responsible for return shipping of defective unit
- Replacement device shipped promptly upon receipt of defective unit
This warranty does NOT cover:
- Software configuration or compatibility issues
- Damage caused by user modification or misuse
- Normal wear and tear
- Issues arising from network configuration
- Third-party software bugs or issues
- Data loss of any kind
- Cosmetic damage that doesn’t affect functionality
7.2 Software Warranty Disclaimer
All software is provided “AS IS” without warranty of any kind. This includes:
- HOMESERVER LLC software components
- Third-party open-source software
- Pre-configured system settings
We make no warranties regarding:
- Functionality for your specific use case
- Compatibility with your network
- Security vulnerabilities in any component
- Fitness for any particular purpose
7.3 Return Policy
30-Day No-Questions-Asked Returns
We accept returns within 30 days of delivery for any reason:
- Full refund of purchase price (excluding original shipping costs)
- Device must be in original condition with all included components
- Customer responsible for return shipping costs
- Refund processed within 10 business days upon receipt and inspection of returned device
- No restocking fees – we want you to be certain this product is right for you
Why we offer this: HOMESERVER is a specialized product requiring technical competence. We’d rather you evaluate it thoroughly and return it if it’s not the right fit than struggle with a product that doesn’t meet your needs.
7.4 Post-Warranty Swap Program
For devices that fail after the 30-day warranty period:
If the swap program is implemented, customers with failed devices may be eligible for:
- Replacement device at 50% of current retail price
- Customer must return the failed device to HOMESERVER LLC
- No questions asked regarding the cause of failure
- Availability subject to inventory and company discretion
- This is not a warranty replacement – it is a goodwill reduced-price purchase option
Timeline Summary:
- Days 1-30: Free warranty replacement for defects OR full refund returns
- Day 31+: 50% swap program available (if implemented)
8. Limitation of Liability
8.1 Maximum Liability
To the fullest extent permitted by law, HOMESERVER LLC’s total liability for any claims arising from your purchase or use of a HOMESERVER shall not exceed the amount you paid for the device.
8.2 No Consequential Damages
HOMESERVER LLC shall not be liable for:
- Lost data or content
- Lost profits or business opportunities
- Network downtime or service interruptions
- Damage to other equipment or property
- Costs of procurement of substitute goods or services
- Any indirect, incidental, consequential, or punitive damages
8.3 Data Loss
You are responsible for backing up your data. HOMESERVER LLC is not responsible for:
- Data loss due to hardware failure
- Data loss due to software bugs or configuration errors
- Data loss due to user error
- Data loss due to security breaches
- Any data loss for any reason
The included backup capabilities are tools you must configure and maintain. We do not automatically back up your data.
8.4 Security Disclaimer
While HOMESERVER is designed with security in mind:
- No system is perfectly secure
- You are responsible for security configuration and maintenance
- You are responsible for keeping software updated
- You are responsible for strong passwords and encryption keys
- HOMESERVER LLC is not liable for security breaches or data theft
9. Privacy and Data Collection
9.1 Our Privacy Commitment
HOMESERVER LLC does not:
- Collect telemetry from devices after deployment
- Track device usage or access patterns
- Require user accounts for device operation
- Phone home or beacon to external services
- Access your device remotely
9.2 What We May Collect
During purchase and shipping:
- Name, shipping address, payment information
- Email address for order confirmation
- Any information voluntarily provided during support interactions
We never collect:
- Device usage data
- Files stored on your device
- Network traffic or browsing history
- Service access logs
- Any personal data from the device itself
9.3 Third-Party Privacy
Third-party services included on HOMESERVER may have their own privacy practices. You are responsible for reviewing and configuring these services according to your privacy requirements.
10. Anonymous Operation
10.1 Company Anonymity
HOMESERVER LLC operates with anonymous principals. This means:
- Individual names and identities are not disclosed publicly
- Company registration and legal structure comply with applicable laws
- All business operations are conducted transparently despite personal anonymity
- Code, specifications, and business practices are open and inspectable
10.2 Why We Operate Anonymously
We operate anonymously to:
- Protect our ability to build privacy-focused tools
- Avoid corporate retaliation for challenging the surveillance economy
- Focus on building products rather than defending personal identities
- Demonstrate that transparency and accountability do not require personal exposure
10.3 Customer Impact
Anonymous operation does not affect:
- Legal enforceability of these terms
- Your ability to receive products or support
- Company accountability or obligations
- Product quality or warranties
11. User Responsibilities
11.1 Maintenance Responsibilities
You are responsible for:
- Installing and configuring the device per documentation
- Performing system updates via the provided GUI
- Maintaining backups of important data
- Securing your device with strong passwords and encryption
- Monitoring system health and performance
- Troubleshooting issues as they arise
11.2 Legal Compliance
You agree to:
- Use HOMESERVER in compliance with all applicable laws
- Not use HOMESERVER for illegal activities
- Respect copyright and intellectual property rights
- Comply with terms of service for any third-party services you configure
- Take responsibility for content stored on your device
11.3 Network Responsibility
You are responsible for:
- Proper network integration and configuration
- Ensuring HOMESERVER does not violate your ISP’s terms of service
- Configuring firewall rules appropriately
- Securing remote access (Tailscale, VPN, etc.)
- Any network issues caused by HOMESERVER configuration
12. Modifications and Updates
12.1 Hardware Modifications
You may freely modify the hardware as it is your property. However:
- Modifications void any hardware warranty
- We cannot provide support for modified hardware
- You assume all risk for modifications
12.2 Software Updates
Software updates are:
- Delivered via GitHub and managed through the HOMESERVER GUI
- Optional – you control when and if to update
- Your responsibility to review, test, and apply
- Not guaranteed to be backwards compatible
We recommend but do not require keeping software updated for security purposes.
12.3 Terms Updates
HOMESERVER LLC may update these Terms and Conditions:
- Updates posted at arpaservers.com/terms with version date
- Continued use of support resources constitutes acceptance of new terms
- Changes do not affect devices already sold (see Radical Ownership)
- Material changes will be announced via email to customers and posted on the website
13. Dispute Resolution
13.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Iowa, without regard to conflict of law principles.
13.2 Informal Resolution
Before initiating formal proceedings, we encourage contacting us via owner@arpaservers.com to attempt informal resolution.
13.3 Litigation
Any disputes arising from these Terms or your purchase that cannot be resolved informally shall be resolved through litigation in the state or federal courts located in the State of Iowa. You consent to the personal jurisdiction of such courts and waive any objection to venue in these courts.
13.4 Class Action Waiver
To the extent permitted by Iowa law, you agree to resolve disputes individually and waive any right to participate in class action lawsuits or class-wide arbitration. This waiver does not apply where prohibited by law.
14. Miscellaneous Provisions
14.1 Entire Agreement
These Terms constitute the entire agreement between you and HOMESERVER LLC regarding your purchase and supersede all prior communications or agreements.
14.2 Severability
If any provision of these Terms is found unenforceable, the remaining provisions shall continue in full effect.
14.3 No Waiver
Failure to enforce any provision does not constitute a waiver of that provision or any other provision.
14.4 Assignment
You may not assign these Terms. HOMESERVER LLC may assign these Terms to a successor entity.
14.5 Force Majeure
HOMESERVER LLC is not liable for delays or failures due to circumstances beyond reasonable control (natural disasters, supply chain disruptions, etc.).
14.6 Export Compliance
You agree to comply with all export control laws and regulations applicable to the technology included in HOMESERVER.

By purchasing HOMESERVER, you acknowledge that:
- You have read and understood these Terms and Conditions
- You accept the “Radical Ownership” model and its implications
- You possess or will develop the technical competence required
- You understand this is professional infrastructure, not a consumer appliance
- You accept responsibility for maintenance, security, and legal compliance
- You understand that no telemetry or remote support is available
- You agree to the warranty limitations and liability disclaimers
- You understand the software licensing arrangements
- You accept the community-driven support model
This is not a “plug and play” consumer product. This is a professional infrastructure platform designed for technically competent users who value privacy and digital sovereignty.
If you do not agree to these terms or lack the technical competence required, do not purchase HOMESERVER.
